Political Constitution of Peru

Number 22 of article 2, establishes that everyone has the right to peace, tranquility, enjoyment of leisure time and rest, as well as to enjoy a balanced and appropriate environment for the development of their lives . For its part, Chapter II and articles 66 to 69 preach that natural resources, renewable and non-renewable, are the Nation's assets, that the State determines the National Environmental Policy, and promotes the sustainable use of its natural resources. , the conservation of biological diversity and protected natural areas, as well as the sustainable development of the Amazon.

Law No. 27867 - Organic Law of Regional Governments

Article 53, of the functions in environmental matters and territorial organization, functions that are intended to be strengthened through the Regional Environmental Policy.

Law No. 28245 - Framework Law of the National Environmental Management System - SNGA

In its title V, in articles 22 and 23 on the regional and local exercise of environmental functions, it indicates the need for Regional Governments to have environmental management instruments, especially with the Regional Environmental Management System and the Policy Regional Environmental

Law No. 28611- General Environmental Law .

Article 8 states that the Environmental Policy has the purpose of defining and guiding the actions of national, regional and local government entities; and the private sector and civil society, in environmental matters. Article 9 on the objective of the Environmental Policy that should allow improving the quality of life of people, guaranteeing the existence of healthy, viable and functional ecosystems in the long term; and the sustainable development of the country, through the prevention, protection and recovery of the environment and its components, the conservation and sustainable use of natural resources, in a responsible manner and consistent with the respect of the fundamental rights of the person.

In its article 10, it establishes that the processes of planning, decision and execution of public policies at all levels of government, including sectoral ones, obligatorily incorporate the guidelines of the National Environmental Policy. Respectively the article 61 ° when referring to the agreement for the regional environmental management, indicates that the Regional Governments, through their Managements of Natural Resources and Management of the Environment, and in coordination with the Regional Environmental Commissions and the National Environmental Authority, implement a Regional System of Environmental Management.

Law No. 26839 - Law on Conservation and Sustainable Use of Biological Diversity .

In article 7, it indicates that it is an instrument where programs and action plans aimed at the conservation of biological diversity, the sustainable use of its components and the fair and equitable sharing of the benefits derived from its use will be established.

Law No. 26834 Law of Protected Natural Areas ,

Norman the aspects related to the management of the Natural Protected Areas and their conservation in accordance with the Political Constitution of Peru

Law No. 30215 - Law on Mechanisms for Compensation for Ecosystem Services and its regulations approved by Supreme Decree No. 009-2016-MINAM .

It establishes that the Ministry has as functions, to exercise the stewardship of the environmental sector that includes the ecosystem services, as well as to design, regulate and promote policies, norms and procedures for the development, implementation and supervision of the mechanisms of retribution for ecosystem services, in coordination with other authorities.

Forestry and Wildlife Law, Law 29763

Regulates the activities of   conservation, protection, increase and sustainable use of forest and wildlife heritage within the national territory in harmony with the Nation's social, economic and environmental interest; as well as promoting forestry development, improving its competitiveness, generating and increasing forest and wildlife resources and their value to society.

Supreme Decree N ° 008-2005-PCM - Regulation of the Framework Law of the National Environmental Management System - In its article 3, it establishes the need for the elaboration of environmental management instruments, contributing to the decentralization and the governability of the country.

Ministerial Resolution No. 0519-2009-AG They declare concluded the process of transfer of functions in agrarian matters contained in the literals "e" and "q" of article 51 of the Organic Law of regional governments, to the technical forest and wildlife administration of the Regional Government of San Martin.

Supreme Decree No. 009-2009-MINAM - Eco-efficiency Measures for the Public Sector and its amendment approved by Supreme Decree No. 011-2010-MINAM  In its article 3 it determines that the measures of eco-efficiency are of obligatory application in all the entities of the public sector, and its fulfillment is obligation of all the persons who render their services to the state, independently of their labor or hiring regime.

Supreme Decree N ° 012-2009-MINAM-National Environmental Policy - that incorporating in its section 6, compliance standards, the obligation to establish concrete and performance indicators among other provisions, which should allow to supervise their effective application, in the three levels of government.

Ministerial Resolution No. 026-2010- MINAM - Policy Guidelines for Territorial Planning .

Whose purpose is to promote and facilitate the sustainable use of renewable natural resources, the use and responsible management of non-renewable natural resources, as well as biological diversity, the orderly occupation of the territory in accordance with its characteristics, potentialities and limitations, conservation of the environment and ecosystems, the preservation of the natural and cultural heritage, the welfare and health of the population.

Supreme Decree No. 014-2011-MINAM - National Environmental Action Plan 2011 -2021 - It is an instrument of long-term national environmental planning, which is formulated, in prospective and contains the priority goals, strategic actions, responsible, as well as the indicators to evaluate their execution by the entities that make up the National System of Environmental Management 

Supreme Decree No. 054-2011-PCM - Bicentennial Plan: Peru by 2021

It establishes as a national objective the conservation and sustainable use of natural resources and biodiversity with an integrated and ecosystem approach and an environment that allows a good quality of life for people and the existence of healthy, road and functional ecosystems in the long term .

Supreme Decree 004-2012-MIMP - National Gender Equality Plan 2012- 2017

Strategic Objective 8 establishes the value of the contribution of women in the sustainable management of natural resources. Specifically, it demands environmental management, at the national and regional levels, with a gender approach, risk management and disaster prevention, as well as management and care of natural resources with a gender focus; and, that rural women who receive information, training and technology transfer for the management of natural resources: water, soil and forests.

Supreme Decree No. 004-2013-PCM , National Policy for the Modernization of Public Management

Supreme Decree No. 007-2016-MINAM - National Strategy on Forests and Climate Change

The National Strategy on Forests and Climate Change (ENBCC) sets the tone for interventions in the public and private sectors to reduce deforestation and achieve conservation, with a long-term vision (until 2030).

Its vision is: "By 2030, Peru has reduced its GHG emissions associated with the USCUSS sector and the vulnerability of the forest landscape and the population that depends on them, ensuring full respect for the rights of citizens, especially those indigenous peoples and peasants, as well as other forest dwellers, with a territorial, intercultural and gender focus. "

National Service of Natural Protected Areas (El Servicio Nacional de Áreas Naturales Protegidas por el Estado - SERNANP) - Established in 2008 as a body within MINAM, SERNANP is the governing body of the National System of Natural Areas Protected by the State (Sinanpe), and in its capacity as a technical-normative authority it carries out its work in coordination with regional governments, local and owners of properties recognized as private conservation areas.Its mission is to ensure the conservation of the country's Natural Protected Areas, their biological diversity and the maintenance of their services environmental

National Forest Service (Servicio Forestal Nacional - SERFOR) - Established in 2014 within the Ministry of Agriculture, SERFOR is the  National Forestry and Wildlife Authority of Peru and the governing body of the National Forestry and Wildlife Management System (SINAFOR). It was created with the Forestry and Wildlife Law (Law No. 29763) and began operations on July 26, 2014. SERFOR carries a mission to promote sustainable and participatory management of forest resources and wildlife, and the use of their ecosystem services, providing quality services that contribute to the well-being of citizens.
