Policies and Strategies

The federally-mandated plan for prevention and control of deforestation (PPCAD) was completed in 2009. It focuses on 3 groups of actions: Land Use and Environmental Planning; Sustainable Economic Activities; and Monitoring and Control. The PPCAD is executed by 23 organizations and governance is carried out by the Forum for Climate Change (representing more than 40 organizations). The strategy is considered to be the primary state environmental policy, focusing on regulating land tenure and creating and maintaining a rural land registry . The PPCAD was formalized through PPCAD / Decree 1697 / June 2009 and has set a goal to reduce the deforestation rate by 80% by 2020.

Due to the 8096/2015 restructuring law of the state of Pará, most of the actions presented in the Plan's matrix of actions were affected. Many were excluded or altered through institutional changes that that altered who would assume the responsibility for executing the action in the scope of the PPCAD. A draft was updated considering the new forest code, as well as other valid regulations and the programs and projects of the state government of Pará that relate the instruments for environmental management and combat deforestation. The draft decree instituting the new PPCAD - PA period is still under analysis for subsequent publication.

Laws and Regulations

Decree 1379, 03/09/2015 - creates the Environmental Regularization Programme for Rural Properties of the State of Pará - PRA/PA

Law 8.096, 2015- Arranges on the reorganization and creates positions in the State Department of Environment and Sustainability - SEMAS, establishes the State Secretariat for Agricultural Development and Fisheries - SEDAP, and clarifies overall institutional arrangements for natural resource management

Decree 54, 2011 - launched the Green Municipalities Program with the objective of fighting deforestation and strengthening sustainable rural production through strategic actions for environmental planning and environmental management with a focus on local pacts, deforestation monitoring, implimentation of the Rural Environmental Registry (CAR) and structuring municipal management

Decree 2099, 01/ 2010- This decree regulates the maintenance and restoration of natural forest regeneration as well as the reforestation and tradeable deforestation rights of Legal Reserve areas in private forests - fully functional

Decree 1697, 06/ 2009 – This decree creates the PPCAD and defines goals, targets, actions and responsibilities within the State governance structure - in process of implementation

Decree 1148, 07/ 2008- This decree declares mandatory registration of every rural property in the State Environmental Registry (CAR) as a first step for any property licensing- fully functional

Law 674, 2005- Establishes the Ecological-Economic Macrozoning of the State of Pará and gives other measures.

Law 5887, 2005- Revision of Law 5887/1995 which established the State Environmental Policy and provided other measures. The revision creates the State Protected Areas System (SEUC)- this system is responsible for the management of protected areas within Pará State - fully functional

Institutional Framework

State Secretariat for Agricultural Development and Fisheries - SEDAP - Created on January 1, 2015, through Law 8.096, signed by Governor Simão Jatene. The new body is the result of the merger of the State Secretariats of Agriculture and Fisheries, with the objective of promoting the sustainable development and strengthening of agricultural, livestock, fishery and aquatic activities in the State of Pará,

Institute Ideflor-Bio - The Institute seeks to exercise the management of public forests for the sustainable production and preservation of biodiversity, including among its functions the management of the state policy for the production and development of the forest chain; and the former preservation, and sustainable use of biodiversity, terrestrial and aquatic fauna and flora in the State.

Secretary for Environment and Sustainability (SEMAS) - created on May 11 , 1988 by Law 5457 and having its most recent reorganization by Law No. 8,096 , January 1, 2015 , SEMAS's mission is to promote integrated, shared and efficient environmental management, compatible with sustainable development, guaranteeing the preservation, conservation of the environment and improvement of the quality of life.

Forum on Climate Change in the State of Pará - Created in June 2009 by decree 1900 and reformulated by Decree no. 518/2012 , the Forum is composed of more than 40 organizations.The Forum was created to promote and support cooperation and dialogue among social sectors related to climate change and its socio-environmental consequences. The Forum is organized in two chambers: (1) a temporary chamber responsible for the development of the Climate Change Bill, and (2) a permanent chamber responsible for the governance of the PPCAD

Zoning and Spatial Planning

Ecological and Economic Zoning (Zoneamento Ecológico-Econômico – ZEE) is required by the Federal Government to designate areas for economic and conservation activities within each state’s territory. Para concluded its macro zoning ZEE in 2005, and has since completed two additional region-specific plans in west and northeast Para. They were all formalized through state laws no 6.745 (2005), no 7.243 (2009) and no 7.604(2012). State decree No. 1,026 created a supervisory committee, technical scientific committee, and working group on ZEE in Para. All ZEEs have been validated by the federal government.

Engagement and Participation with Indigenous Peoples and Local Communities

Currently, indigenous peoples and traditional communities are included in the programs developed by the Institute for Forest Development and Biodiversity (IDEFLOR-Bio), supported by partnerships with the National Indian Foundation (FUNAI) and representative organizations for the construction of Plans National Indigenous Territorial Management (PNGATI) for indigenous peoples, as well as support in the recognition of territories of quilombola and traditional communities. There are opportunities for participation of Indigenous Peoples and Traditional Communities through the Methodology Evaluation Workshops of the REDD + Safeguards Information System, promoted by the Federal Government, through the Ministry of the Environment (MMA).
